The Terms and Conditions
These Terms and Conditions (hereinafter referred to as the “T&Cs” or the “Rules”) shall solely govern the use of the Site and its operation and they shall become immediately applicable on registration of an account (hereinafter referred to as the “User Account”) of every new player (hereinafter referred to as the “Player”) with the Site. Non-adherence to the rules hereunder described shall give Totallygame the right to annul the agreement and block a User Account.
The T&Cs shall cease to have effect upon the closing of the User Account in whatever manner as described hereunder.
The Player must read the Terms and Conditions before proceeding to play the games provided by the Operator. Mere use of the Site following registration of the Player’s account is a tacit acknowledgement and acceptance of all the rules herein provided without any reservation. It is recommended that these Terms and Conditions are printed in hard copy for easy reference.
Modification and Updates of the T&Cs
Totallygame hereby reserves the right to modify the Rules herein provided at any time as it deems fit in order to improve the Site, its operation, security and efficiency.
The updates and modifications shall be the effective version of the T&Cs from the moment that they are published on the Site. However, a Player that signs in to his account on the Site subsequent to a modification or update to the T&Cs, will be notified of such modification or update by means of a ‘pop-up window’. The Player must click ‘I accept’ before proceeding with playing on the Site. The T&Cs shall be applicable vis-à-vis the Player from the moment the Player clicks ‘I accept’. Refusal of the modifications and updates of the T&Cs shall prevent the Player from making further use of the Site.

Applicable law and Forum
The T&Cs shall solely be governed by the laws of Malta without any regard for any conflict of laws.
In the cases of any dispute that shall arise with regard to the T&Cs or in general regarding the contract between the Operator and the Player, the laws of Malta shall apply. If the Parties do not reach an agreement to their dispute, they shall submit themselves to the jurisdiction of the Maltese Courts.
Player Registration and User Accounts
In order to play and make use of the Site, every person must register as a Player and thus have a User Account in his name. Every Player cannot hold more than one open account in his name. The holding of more than one account is strictly forbidden. Totallygame reserves the right to refuse to open an account or to cancel an account wherever it has reason to believe that a Player has registered/attempted to register more than one account under different names with the intent of defrauding or cheating the Company.
Totallygame reserves the right to close or suspend the operation of a User Account until the issue is resolved when it has any evidence of misuse or abuse of the User Account.
A person who wishes to register as a player, must first fill in and submit the Application Form provided by Totallygame. This Application Form shall display the person’s name, age, identity, place of residence and valid e-mail address. No person under 18 years of age shall be allowed to register as a Player. Furthermore, the person seeking to register an account shall be asked to present a copy of some form of identification document such as an Identity Card, Passport or Driver’s License.
If the Player makes any changes to the details provided upon Registration, it is his responsibility to notify the Operator of the change.
The Operator reserves the right to assume that all the personal details provided by the Player on registration are true and correct until such time when the Player himself amends the personal details initially entered by him. The Operator further reserves the right to refuse to open an account, cancel an account, refuse deposits and/or withdrawals in all those cases where it has reason to believe that false, inaccurate, deceitful or incomplete information was given or in the case of any criminal behaviour on the part of the Player.
User Name and Password
As part of the registration process, the customer shall be requested to submit a user name and password that will be required every time the Player would like to access the account. Alternatively, Totallygame may provide a user name and password. User names must be particular to each individual player. Passwords must be strong and non-predictable.
The Player is responsible for assuring that his user name and password are kept secret at all times. Should the Player become aware that his user name and password have been obtained and are being used by another person, it is his responsibility to duly inform Totallygame immediately which shall then inspect and verify the account. The Player shall then provide a new user name and password, or alternatively Totallygame shall provide a new user name and password to the Player for future use in the method described hereunder. Future transactions carried under the old details shall be considered void.
If at any time, the Player forgets the user name and/or password chosen by him or provided by Totallygame, there shall be the possibility of obtaining a new password.
Where, for any of the cases above, a new password must be provided to the Player, the system shall automatically reset the password, which will be unknown to any of Totallygame employees, and send the same to the Player via e-mail.
Totallygame reserves the right to change a Player’s user name whenever it deems it so fit in its discretion for the purposes of privacy and security.
Anti-Money Laundering
The Player hereby binds himself by all the relevant Anti-Money Laundering Regulations in force in Malta and across the European Union. The Player therefore binds himself not to use the gaming services provided by the Operator (hereinafter referred to as the “Services”) and/or the Site for the purposes of money laundering and/or the funding of terrorism, whether directly or indirectly.
Totallygame reserves the right to take any measures that would be required in order to obtain or verify a Player’s identification. Totallygame shall likewise have the right to refuse the opening of an account, cancel/suspend an account, refuse deposits and/or withdrawals in all those cases where it has suspicion that the Player is making use of such illicit purposes or that a transaction was used for such purposes. Finally, Totallygame has the right to disclose details of the suspicious transaction to the appropriate authorities in Malta being the LGA and the Financial Intelligence Analysis Unit.
Eligibility of Players
Players under 18 years of age are prohibited from making use of the gaming services of Totallygame. Residents of the USA, whatever their age, and the residents of any other country which prohibits the playing of online games such as those provided by Totallygame, are also prohibited from making use of the Site and opening an account with the Operator. Estonian residents under 21 years of age are also prohibited from playing online games. It is the responsibility of every Player to check the laws of his/her jurisdiction before proceeding to open an account on the Site and play on the Site.
Totallygame reserves the right to forfeit any funds deposited or won by a person under 18 years of age, or 21 years of age, or won by a person from a jurisdiction where online gaming is absolutely prohibited, as the case may be, to the Authority.
There is a prohibition vis-à-vis all employees, executives, managers, directors, agents, consultants, sellers, providers and other person having access to inside information of the Company and its Services during their term of engagement/employment with Totallygame. These persons shall not be allowed to open an account with the Site and make use of the Totallygame services. The same applies to Totallygame relatives (spouses, partners, parents, children, siblings) without proper authorization from Totallygame.
Totallygame reserves the right to refuse to open an account or cancel the relevant account on discovery of the above as the case may be.
Closing of Accounts
Closing of a User Account may take place at any time by agreement between Totallygame and the Player.
Any Player may close his account by sending an e-mail or fax to the Operator after having requested withdrawal of the remaining balance from the account. The Player shall be held responsible for any transactions carried out until final closure of the account is affected.
If a User Account is not accessed for a period of thirty (30) months, the account shall be deemed to be inactive and will be closed. The remaining balance will be remitted to the Player or to the LGA if the Player cannot be satisfactorily located. No claim shall lie against Totallygame after it has remitted the balance to the LGA.
FINANCIAL RULES AND ISSUES
Deposits
Totallygame shall not accept cash from players and funds may only be received by means of credit or debit cards and bank draft. Use shall also be made of Moneybookers and Neteller. When making payments with a credit card, the Player must first submit an image of both sides of the card that will be used in making the payment.
The Player can only make use of a credit/debit card of which he is proprietor. Any deposits made using another individual’s credit/debit card will be refunded and all relevant transactions shall be deemed void.
A minimum amount of fifteen euro (EUR 15) shall be deposited to allow the opening of a User Account.
Totallygame reserves the right to set and vary a maximum amount of funds that can be deposited per transaction.
Withdrawals
A player may request a partial or full withdrawal from the balance of his account at any time, provided that the first deposit in the User Account was made at least fifteen (15) days prior to request and provided also that all payments have been confirmed. All payouts shall be credited to the same account that was used to make the deposit, save in those cases where Mastercard shall have been the method of deposit into the User Account.
Totallygame shall ensure that withdrawal requests are received not later than 5 days from the date of the request.
Totallygame shall not impose any additional charges on a Player who requests a withdrawal, as long as the amount requested for withdrawal exceeds the minimum of fifteen Euro (EUR 15) or the equivalent in another currency. If the amount requested does not exceed the said amount, there shall be a charge of EUR 3 per every request.
Winnings
Winnings shall be remitted to the Player following confirmation of the final result at the name and address details provided by the Player on registration or that following any change appropriately submitted by the Player. They shall be credited to the same account that was used by the Player to make the deposit, save in those cases where Mastercard shall have been the method of deposit into the User Account.
Totallygame reserves the right to suspend a cash-out pending verification of the Player’s identity, age and residence, the actual playing of the game by the Player, and also in order to conduct adequate security and other internal procedures and checks in relation to the User Account. In the event that the identification provided by the winner does not correspond with that of the User Account, Totallygame shall reserve the right to annul the bets and winnings.
In any case, Totallygame shall not make a cash-out exceeding EUR 2,300 until the Player’s identity, age and residence have been verified.
Totallygame shall ensure that winnings are received not later than 5 days from the date of the request.
Totallygame reserves the right to reverse any errors made in the calculation of the Player’s winnings. On becoming aware of such error, the Player shall immediately be notified of the error in the calculation and has ten (10) days to appeal to the new value of the calculation. Failure to appeal within the said timeframe shall mean tacit acceptance of the miscalculation and subsequent forfeiture of the discrepancy in calculations.
Bonuses and Promotions
Totallygame may from time to time organize competitions or promotions, and may also provide various bonuses. Players shall only become eligible for participation in such competitions, promotions and bonuses after having played games provided by the Operator on the Site three (3) times.
Specific rules, which shall be published at the relevant time of the event, will apply for the different competitions, promotions and bonuses. Totallygame reserves the right to remove, amend and update these specific rules as it deems fit at any time, without being held liable by the Player. If it has reasonable suspicion to believe that abusive behavior was conducted by participants in bonuses, promotions or competitions, Totallygame reserves the right to annul such bonuses, promotions and competitions and cancel a transaction or block a User Account if it deems so necessary.
RULES RELATING TO THE SOFTWARE
End-User License
When the Player opens a User Account on the Site, he is thereby granted a personal non-exclusive, non-transferable, non-commercial license to use the software licensed by the LGA, including all relevant programs and databases and other derived content (hereinafter referred to as the “Software”) in order to play the games of chance that are offered by the Operator according to the T & Cs. The Software and source code are solely the property of the Operator and the Player agrees that nothing shall be done to modify, adapt, disassemble the Software or attempt to decode the Software or any part of it. Finally, the Player agrees not to create, publish or distribute derivative works from the Software.
Installation and back-ups of the Software are not prohibited in as far as they are for the sole personal use of the Player in accordance with the Rules.
The Player further agrees not to transfer or export the Software to any other country or in any other manner that is contradictory with these Rules, any applicable laws or regulations.
Intellectual Property Rights
The Site may only be used according to all relevant laws and regulations. It is intended for the sole use of every registered player and may not be used by any other third parties. The Site and the Software may not be copied, modified or reproduced and any downloading must be done following the proper authorizations.
Artificial Intelligence Software
The use of Artificial Intelligence in connection with the Software and game playing is absolutely prohibited. The Player hereby binds himself to refrain from making use of such programmes and devices in relation to the Software and for the purposes of playing games on the Site. Totallygame is committed to detecting the use of such programmes and devices and preventing them from being used on the Totallygame service. Totallygame reserves the right to take any measures it deems necessary in order to detect use of A.I. Software.
Anti-Collusion Measures
Totallygame adheres to a policy of anti-collusion. The Company is committed to detecting any form of collusion amongst two or more players, or any other arrangement whereby two or more players attempt to deceive or otherwise defraud the Company and thus obtain an unfair advantage over other players.
Anti-Money Laundering and other Fraudulent Activity
The Player hereby agrees that the Site shall not be used by him for the purposes of money laundering, the funding of terrorism, or for the purposes of any other fraudulent or illicit activity. He shall not use the Site or the Software for the purpose of transferring funds from illegal sources and certifies that the funds used for the playing of games on the Site are not from any illegal source. The Player is further prohibited from otherwise cheating or defrauding the Operator.
Totallygame reserves the right to detect all attempts to cheat or defraud the Operator and consequentially to suspend or close a User account and/or cancel the relevant transaction. In cases where Totallygame reasonably suspects the legality of the source of funds, or that the Site has been used in any way for any of the purposes described above, it reserves the right to temporarily suspend an account, or cancel an account and/or transaction however it may deem fit.
Responsible Gaming and Financial Protection
Totallygame endorses a policy of responsible gaming. Its employees are trained in recognizing potential problem gamblers. If problem gamblers are identified, Totallygame and any of its employees may prevent the Player from using the Site, and may also be removed from the Operator’s mailing list, following such request from the Player.
Totallygame shall not provide any form of credit to the Player.
The Player may, in writing or via email or fax, also request Totallygame to set the following limits and/or conditions:
(A) Set a limit on the amount the player may wager within a specific period of time;
(B) Set a limit on the losses the player may incur within a specific period of time
(C) Set a limit on the amount of time the player may play in any one session;
(D) Exclude the player from playing for a definite or indefinite period of time.
A player who has set a limit or exclusion may change or revoke the limit or exclusion by written notice or electronic notice given to Totallygame.
A notice increasing or revoking a limit or decreasing the exclusion has effect only after seven (7) days after Totallygame has received the notice.
A notice reducing a limit or increasing the exclusion has effect immediately after it is received by Totallygame.
Totallygame shall not accept a wager from a player contrary to a limit or exclusion set by the player under this regulation.

Privacy and Security
Totallygame ensures its customers that all the proper checks are in place to ensure the utmost privacy and security of every User Account.
Totallygame is registered with the Data Protection Commissioner of Malta in accordance with the Data Protection Act and all other relevant legislation. By registering a User Account, the Player is hereby accepting that all personal information provided to the Company shall be treated in utmost confidentiality and shall not be stored longer than is absolutely necessary in accordance with the relevant laws. If there arises the need to submit any personal details to a third party, Totallygame ensures that the Player shall be first notified and no information will be submitted before the Player gives his explicit consent. Totallygame further ensures its customers that all personal data requested is processed fairly and lawfully, and is obtained only for a specific and lawful purpose and is at all times relevant and not excessive to its purpose.
Privacy and security are also of prime importance in relation to the player’s funds. Totallygame shall only deal with the players’ monies in any of the following instances:
a) to debit to the account a wager made by the player or an amount the player indicates the player wants to wager in the course of an authorised game the player is playing or about to play;
b) to remit funds standing to the credit of the account to the player, at the player’s request;
c) to pay reasonable bank charges for deposits received and funds withdrawn;

Totallygame reserves the right to conduct a security review at any time as it may deem fit in order to ensure that its security levels are at their highest. The Player thus hereby also undertakes to provide to the Company any information that may be necessary for the above.
Disclaimer and Limitation of Liability
Totallygame shall not undertake any responsibility for any consequences whatever they may entail, that follow from any of the following actions:
a) violation of the Rules or any other applicable laws or regulations;
b)any criminal act.
Totallygame shall not undertake responsibility for any changes made to a User Account and/or the User Account balance as a result of the actions of a third party playing the games using the User Account of the player
Totallygame shall not undertake responsibility for any financial losses that result from playing the games, including but not limited to variances in exchange rates.
Totallygame shall not undertake responsibility for any loss or damage including but not limited to pecuniary losses, which may be suffered by the Player in any of the following events caused by him:
a) commercial use of the Service or Software;
b) modification, suspension, interruption of the Service or the Software;
c) improper use of the Service or Software.
While the Operator shall do its utmost to ensure that the Service and Software are in constant adequate working order, it does not guarantee that there shall be no disturbances. Totallygame further does not guarantee that the Service and the Software are entirely authorized and that they shall entirely satisfy the Player, that they are entirely free from error, virus or bug, and that they are totally reliable and uninterruptable.
Totallygame shall not undertake responsibility for any loss or damage including but not limited to pecuniary losses that is caused by delay, interruption, corruption and/or improper functioning of the Service or Software as described above.

Deposits
Totallygame shall not accept cash from players and funds may only be received by means of credit or debit cards and bank draft. Use shall also be made of Moneybookers and Neteller. When making payments with a credit card, the Player must first submit an image of both sides of the card that will be used in making the payment.
The Player can only make use of a credit/debit card of which he is proprietor. Any deposits made using another individual’s credit/debit card will be refunded and all relevant transactions shall be deemed void.
A minimum amount of fifteen euro (EUR 15) shall be deposited to allow the opening of a User Account.
Totallygame reserves the right to set and vary a maximum amount of funds that can be deposited per transaction.
Withdrawals
A player may request a partial or full withdrawal from the balance of his account at any time, provided that the first deposit in the User Account was made at least fifteen (15) days prior to request and provided also that all payments have been confirmed. All payouts shall be credited to the same account that was used to make the deposit, save in those cases where Mastercard shall have been the method of deposit into the User Account.
Totallygame shall ensure that withdrawal requests are received not later than 5 days from the date of the request.
Totallygame shall not impose any additional charges on a Player who requests a withdrawal, as long as the amount requested for withdrawal exceeds the minimum of fifteen Euro (EUR 15) or the equivalent in another currency. If the amount requested does not exceed the said amount, there shall be a charge of EUR 3 per every request.
Winnings
Winnings shall be remitted to the Player following confirmation of the final result at the name and address details provided by the Player on registration or that following any change appropriately submitted by the Player. They shall be credited to the same account that was used by the Player to make the deposit, save in those cases where Mastercard shall have been the method of deposit into the User Account.
Totallygame reserves the right to suspend a cash-out pending verification of the Player’s identity, age and residence, the actual playing of the game by the Player, and also in order to conduct adequate security and other internal procedures and checks in relation to the User Account. In the event that the identification provided by the winner does not correspond with that of the User Account, Totallygame shall reserve the right to annul the bets and winnings.
In any case, Totallygame shall not make a cash-out exceeding EUR 2,300 until the Player’s identity, age and residence have been verified.
Totallygame shall ensure that winnings are received not later than 5 days from the date of the request.
Totallygame reserves the right to reverse any errors made in the calculation of the Player’s winnings. On becoming aware of such error, the Player shall immediately be notified of the error in the calculation and has ten (10) days to appeal to the new value of the calculation. Failure to appeal within the said timeframe shall mean tacit acceptance of the miscalculation and subsequent forfeiture of the discrepancy in calculations.
Bonuses and Promotions
Totallygame may from time to time organize competitions or promotions, and may also provide various bonuses. Players shall only become eligible for participation in such competitions, promotions and bonuses after having played games provided by the Operator on the Site three (3) times.
Specific rules, which shall be published at the relevant time of the event, will apply for the different competitions, promotions and bonuses. Totallygame reserves the right to remove, amend and update these specific rules as it deems fit at any time, without being held liable by the Player. If it has reasonable suspicion to believe that abusive behavior was conducted by participants in bonuses, promotions or competitions, Totallygame reserves the right to annul such bonuses, promotions and competitions and cancel a transaction or block a User Account if it deems so necessary.
RULES RELATING TO THE SOFTWARE
End-User License
When the Player opens a User Account on the Site, he is thereby granted a personal non-exclusive, non-transferable, non-commercial license to use the software licensed by the LGA, including all relevant programs and databases and other derived content (hereinafter referred to as the “Software”) in order to play the games of chance that are offered by the Operator according to the T & Cs. The Software and source code are solely the property of the Operator and the Player agrees that nothing shall be done to modify, adapt, disassemble the Software or attempt to decode the Software or any part of it. Finally, the Player agrees not to create, publish or distribute derivative works from the Software.
Installation and back-ups of the Software are not prohibited in as far as they are for the sole personal use of the Player in accordance with the Rules.
The Player further agrees not to transfer or export the Software to any other country or in any other manner that is contradictory with these Rules, any applicable laws or regulations.
Intellectual Property Rights
The Site may only be used according to all relevant laws and regulations. It is intended for the sole use of every registered player and may not be used by any other third parties. The Site and the Software may not be copied, modified or reproduced and any downloading must be done following the proper authorizations.
Artificial Intelligence Software
The use of Artificial Intelligence in connection with the Software and game playing is absolutely prohibited. The Player hereby binds himself to refrain from making use of such programmes and devices in relation to the Software and for the purposes of playing games on the Site. Totallygame is committed to detecting the use of such programmes and devices and preventing them from being used on the Totallygame service. Totallygame reserves the right to take any measures it deems necessary in order to detect use of A.I. Software.
Anti-Collusion Measures
Totallygame adheres to a policy of anti-collusion. The Company is committed to detecting any form of collusion amongst two or more players, or any other arrangement whereby two or more players attempt to deceive or otherwise defraud the Company and thus obtain an unfair advantage over other players.
Anti-Money Laundering and other Fraudulent Activity
The Player hereby agrees that the Site shall not be used by him for the purposes of money laundering, the funding of terrorism, or for the purposes of any other fraudulent or illicit activity. He shall not use the Site or the Software for the purpose of transferring funds from illegal sources and certifies that the funds used for the playing of games on the Site are not from any illegal source. The Player is further prohibited from otherwise cheating or defrauding the Operator.
Totallygame reserves the right to detect all attempts to cheat or defraud the Operator and consequentially to suspend or close a User account and/or cancel the relevant transaction. In cases where Totallygame reasonably suspects the legality of the source of funds, or that the Site has been used in any way for any of the purposes described above, it reserves the right to temporarily suspend an account, or cancel an account and/or transaction however it may deem fit.
Responsible Gaming and Financial Protection
Totallygame endorses a policy of responsible gaming. Its employees are trained in recognizing potential problem gamblers. If problem gamblers are identified, Totallygame and any of its employees may prevent the Player from using the Site, and may also be removed from the Operator’s mailing list, following such request from the Player.
Totallygame shall not provide any form of credit to the Player.
The Player may, in writing or via email or fax, also request Totallygame to set the following limits and/or conditions:
(A) Set a limit on the amount the player may wager within a specific period of time;
(B) Set a limit on the losses the player may incur within a specific period of time
(C) Set a limit on the amount of time the player may play in any one session;
(D) Exclude the player from playing for a definite or indefinite period of time.
A player who has set a limit or exclusion may change or revoke the limit or exclusion by written notice or electronic notice given to Totallygame.
A notice increasing or revoking a limit or decreasing the exclusion has effect only after seven (7) days after Totallygame has received the notice.
A notice reducing a limit or increasing the exclusion has effect immediately after it is received by Totallygame.
Totallygame shall not accept a wager from a player contrary to a limit or exclusion set by the player under this regulation.

Privacy and Security
Totallygame ensures its customers that all the proper checks are in place to ensure the utmost privacy and security of every User Account.
Totallygame is registered with the Data Protection Commissioner of Malta in accordance with the Data Protection Act and all other relevant legislation. By registering a User Account, the Player is hereby accepting that all personal information provided to the Company shall be treated in utmost confidentiality and shall not be stored longer than is absolutely necessary in accordance with the relevant laws. If there arises the need to submit any personal details to a third party, Totallygame ensures that the Player shall be first notified and no information will be submitted before the Player gives his explicit consent. Totallygame further ensures its customers that all personal data requested is processed fairly and lawfully, and is obtained only for a specific and lawful purpose and is at all times relevant and not excessive to its purpose.
Privacy and security are also of prime importance in relation to the player’s funds. Totallygame shall only deal with the players’ monies in any of the following instances:
a) to debit to the account a wager made by the player or an amount the player indicates the player wants to wager in the course of an authorised game the player is playing or about to play;
b) to remit funds standing to the credit of the account to the player, at the player’s request;
c) to pay reasonable bank charges for deposits received and funds withdrawn;
d) as is otherwise authorised by the Remote Gaming Regulations 2004.
Totallygame ensures its customers that the credit card details and other related details will never be communicated to any third parties except financial institutions dealing with a relevant transaction, or to any other relevant authority, when the divulgence of such information is required for the purposes of security, including but not limited to the adherence of anti-money laundering regulations.
Totallygame reserves the right to conduct a security review at any time as it may deem fit in order to ensure that its security levels are at their highest. Totallygame further reserves the right to make any inquiry deemed necessary into the User Account and if necessary, disclose such information to a third party for verification purposes. The Player thus hereby also undertakes to provide to the Company any information that may be necessary for the above.
Disclaimer and Limitation of Liability
Totallygame shall not undertake any responsibility for any consequences whatever they may entail, that follow from any of the following actions:
a) violation of the Rules or any other applicable laws or regulations;
b)any criminal act.
Totallygame shall not undertake responsibility for any changes made to a User Account and/or the User Account balance as a result of the actions of a third party playing the games using the User Account of the player
Totallygame shall not undertake responsibility for any financial losses that result from playing the games, including but not limited to variances in exchange rates.
Totallygame shall not undertake responsibility for any loss or damage including but not limited to pecuniary losses, which may be suffered by the Player in any of the following events caused by him:
a) commercial use of the Service or Software;
b) modification, suspension, interruption of the Service or the Software;
c) improper use of the Service or Software.
While the Operator shall do its utmost to ensure that the Service and Software are in constant adequate working order, it does not guarantee that there shall be no disturbances. Totallygame further does not guarantee that the Service and the Software are entirely authorized and that they shall entirely satisfy the Player, that they are entirely free from error, virus or bug, and that they are totally reliable and uninterruptable.
Totallygame shall not undertake responsibility for any loss or damage including but not limited to pecuniary losses that is caused by delay, interruption, corruption and/or improper functioning of the Service or Software as described above.

Totallygame will do its utmost to respond to and resolve a complaint at the earliest.
